VII. Consent to Override DND

By using the Platform and its services, you specifically provide consent to the Company to send you transaction, service explicit and service implicit communications which are essential to continue the services like sending OTP for log-in, Status of Application etc., irrespective of your Do Not Disturb Registration with TRAI, DoT and/or any other Appropriate Authority. Similarly, you provide your explicit consent for sending across various communications on your registered email as well as phone number through various communication applications like WhatsApp as may be integrated with portal in future.

VIII. Sharing of Personal Data / Disclosure of Personal Information

As a policy we do not disclose any personal information to anyone other than our employees, officers, professional advisors, third party contractors, and third party service providers as reasonably necessary for the purposes set out in this Policy.

We do not disclose your Personal Information without your permission unless required by law or lawful requests from government authorities. However, we may share aggregate information with selected clients, service providers, and partners, ensuring individual names and identifying information are not disclosed.

X. Digital Personal Data Protection Act, 2023 Compliance

The Company is committed to complying with the provisions of the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the rules framed thereunder, as and when they come into force. In this regard, the following shall apply:

A. Data Fiduciary

The Company acts as a “Data Fiduciary” as defined under the DPDP Act, responsible for determining the purpose and means of processing of your personal data.

B. Consent

The Company shall process your personal data only upon obtaining your free, informed, specific, and unambiguous consent through a clear affirmative action. You may withdraw your consent at any time; however, withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Withdrawal of consent may result in the Company being unable to provide certain services to you.

C. Rights of Data Principal

As a Data Principal (i.e., the individual to whom the personal data relates), you shall have the following rights under the DPDP Act:

Right to access information about personal data being processed;

Right to correction and erasure of personal data that is inaccurate, incomplete, or no longer necessary for the purpose for which it was collected;

Right of grievance redressal in relation to the exercise of rights under the DPDP Act;

Right to nominate any individual who shall, in the event of death or incapacity of the Data Principal, exercise the rights of the Data Principal.

D. Obligations of the Company

The Company shall, as a Data Fiduciary:

Process personal data only for lawful purposes and in accordance with applicable provisions of the DPDP Act;

Implement appropriate technical and organizational measures to ensure security of personal data;

Notify the Data Protection Board of India and affected Data Principals in the event of a personal data breach, as required under the DPDP Act;

Erase personal data upon withdrawal of consent or upon the purpose for which it was collected no longer being served, unless retention is required by law;

Not transfer personal data to countries or territories outside India except in accordance with such terms and conditions as may be specified by the Central Government.

E. Data Protection Officer

The Company shall appoint a Data Protection Officer (DPO) as and when required under the DPDP Act. Until such time, all queries, corrections, or complaints relating to personal data may be directed to the Grievance Officer mentioned in Section XXIX of this Policy.

F. Significant Data Fiduciary

In the event the Company is notified as a “Significant Data Fiduciary” under the DPDP Act, it shall undertake additional obligations including appointment of a Data Protection Officer, an independent data auditor, and periodic data protection impact assessments, as may be required under the DPDP Act and the rules framed thereunder.

G. Artificial Intelligence and Automated Processing

As an artificial intelligence and data engineering company, Tecblic may use automated processing, machine learning models, and other artificial intelligence tools, including third-party and generative AI tools, in the course of providing its services and in its internal business communications. Where personal data is processed using such tools, the Company shall implement appropriate technical and organisational safeguards, restrict the use of client and Personal Information for training publicly available or third-party AI models without consent, and ensure that any automated decision-making that produces legal or similarly significant effects on a Data Principal is subject to appropriate human oversight, in accordance with the DPDP Act and other applicable Data Protection Laws.

XI. Sensitive Personal Data or Information (SPDI)

We handle sensitive categories of personal data, including financial information, payment details, and government-issued identification/KYC documents (where furnished for vendor or client onboarding), with utmost care and confidentiality. We collect such information solely for the purpose of providing our services and do not disclose it without your explicit consent, except as required by law. We comply with the provisions of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and the DPDP Act, 2023 when processing such information.
